Yasashi Ōkami Online Store Terms and Conditions

I. General Provisions

  1. These Terms and Conditions define the rules for using the online store operating at yasashiokami.com, including the rules for the provision of electronic services, placing orders, concluding sales contracts, deliveries, payments, withdrawal from contracts, and submitting complaints.
  2. The online store is operated by Yaser Sharov, conducting business under the name YesSales - Yaser Sharov, with the business address: Słowicza 10, 53-320 Wrocław, NIP: 8992971218, REGON: 526372415, hereinafter referred to as the "Seller".

  4. The Terms and Conditions are made available free of charge on the Store's website in a way that allows them to be obtained, reproduced, and saved.
  5. The Store conducts sales within the European Union, to consumers and entrepreneurs.
  6. The Seller conducts sales only to adults. By placing an order, the Customer declares that they are 18 years of age or older and have full legal capacity or act through an authorized person.
  7. Information placed in the Store, in particular descriptions, photos, parameters, prices, and availability of Goods, constitutes an invitation to conclude a contract within the meaning of the provisions of the Civil Code.

II. Definitions

The terms used in these Terms and Conditions mean:

  1. Business Days - days from Monday to Friday, excluding public holidays.
  2. Customer - a natural person, legal person, or organizational unit with legal capacity, making purchases in the Store.
  3. Consumer - a natural person performing a legal act with the Seller not directly related to their business or professional activity.
  4. Privileged Entrepreneur - a natural person concluding a contract directly related to their business activity, when the content of the contract indicates that it does not have a professional character for that person.
  5. Entrepreneur - a Customer who is neither a Consumer nor a Privileged Entrepreneur.
  6. Store - the online store operating at yasashiokami.com.
  7. Goods - products available for sale in the Store, in particular knives, stones, and accessories.
  8. Custom Order Goods - Goods imported or prepared individually for a specific Customer's order, not available as standard stock.
  9. Sales Contract - a contract for the sale of Goods concluded between the Seller and the Customer through the Store.
  10. Electronic Services - services provided by the Seller electronically, in particular, Account management and the contact form.
  11. Account - the Customer's individual panel in the Store.
  12. Terms and Conditions - these Terms and Conditions.

III. Rules for using the Store

  1. Using the Store requires:
    • a device with Internet access,
    • an up-to-date web browser,
    • an active e-mail address,
    • cookies and JavaScript enabled, if required for the proper functioning of the Store.
  2. The Customer is obliged to:
    • use the Store in accordance with the law, these Terms and Conditions, and good practice,
    • not to provide illegal content,
    • not to undertake activities disrupting the functioning of the Store.
  3. The Seller takes necessary actions to ensure the proper functioning of the Store, however, the use of electronic services may involve typical risks associated with data transmission over the Internet.

IV. Electronic Services

Customer Account

  1. The Seller enables the creation of an Account in the Store.
  2. Account registration takes place by completing the registration form and accepting the Terms and Conditions.
  3. The Account maintenance agreement is concluded for an indefinite period.
  4. The Customer may delete the Account at any time by contacting the Seller or using the functionality available in the Store, if implemented.

Contact Form

  1. The Seller enables contact via the contact form.
  2. The agreement for the provision of the contact form service is concluded for a specified period and is terminated upon sending the message.

Complaints regarding electronic services

  1. Complaints regarding the functioning of the Store or electronic services can be submitted to: info@yasashiokami.com.
  2. The complaint should contain data enabling the identification of the Customer and a description of the problem.
  3. The Seller will process the complaint within 14 days from the date of its receipt.

V. Customer Account

  1. The Customer is obliged to provide true and up-to-date data.
  2. The Customer is responsible for maintaining the confidentiality of login data to the Account.
  3. It is forbidden to share the Account with third parties.
  4. The Seller may block the Account in case of violation of the Terms and Conditions, after prior notification to the Customer to cease the violations, unless the violation is egregious.

VI. Rules for placing orders and concluding contracts

  1. Orders can be placed through the Store's website 24 hours a day, 7 days a week.
  2. To place an order, the Customer:
    • selects the Goods,
    • adds the Goods to the basket,
    • provides delivery details,
    • selects the delivery and payment method,
    • confirms familiarity with the Terms and Conditions,
    • places an order with the obligation to pay.
  3. After placing the order, the Seller sends a confirmation of its receipt to the Customer's e-mail address.
  4. The sales contract is concluded upon the Seller's acceptance of the order for execution.
  5. The Seller may contact the Customer to confirm order details, especially for Custom Order Goods.
  6. The sales contract is concluded in Polish.

VII. Goods and Availability

  1. The Seller offers in the Store, in particular, knives, sharpening stones, and accessories.
  2. All Goods are brand new, unless explicitly stated otherwise in the product description.
  3. Product photos are for illustrative purposes. Due to the natural properties of materials, especially wood, steel, handmade finishes, and product photography, the actual appearance of the Goods may slightly differ from what is presented in the Store.
  4. For Custom Order Goods, the lead time may differ from the standard and is indicated with the product or agreed individually with the Customer before concluding the contract.

VIII. Prices and Payments

  1. Prices of Goods in the Store are expressed in Polish zlotys and include VAT, if applicable.
  2. The total price of the order includes the price of the Goods and the delivery cost indicated during the ordering process.
  3. The Customer can use the following payment methods:
    • payment card,
    • bank transfer,
    • BLIK.
  4. Payment for the order takes place during the ordering process, unless the Seller explicitly allows another form of settlement for a given case.
  5. In case of lack of effective payment, the Seller may cancel the order.

IX. Delivery

  1. Deliveries are carried out within the European Union.
  2. Available delivery methods:
    • InPost,
    • DHL.
  3. Delivery costs are provided to the Customer during the ordering process, in accordance with the current delivery price list.
  4. For orders with a value of 500 PLN or more, delivery within Poland is free, provided that information about free delivery was available when placing the order.
    The standard order processing time is 1 business day, unless the product description or order information states otherwise.
  5. Delivery time depends on the country of delivery and the chosen carrier.
  6. Proof of purchase is delivered in accordance with applicable legal provisions.

X. Right of withdrawal from the contract

  1. A Consumer and a Privileged Entrepreneur have the right to withdraw from a distance contract without giving a reason within 14 days.
  2. The deadline for withdrawal from the contract runs from the day the Customer or a third party indicated by them, other than the carrier, takes possession of the Goods.
  3. To exercise the right of withdrawal, the Customer should submit an unambiguous statement to the Seller, e.g., by sending a message to: info@yasashiokami.com.
  4. After withdrawing from the contract, the Customer should return the Goods immediately, no later than 14 days from the date of submitting the withdrawal statement.
  5. Returns should be made to the address:

  6. The Seller will reimburse the Customer for all payments received, including delivery costs, immediately, no later than 14 days from the day of receiving the withdrawal statement, subject to the right to withhold reimbursement until the Goods are returned or proof of their return is provided.
  7. Payment reimbursement will be made using the same payment method used by the Customer, unless the Customer explicitly agrees to another method.
  8. The cost of returning the Goods in case of withdrawal from the contract is borne by the Seller, in accordance with the policy adopted by the Store.
  9. The Customer is liable for any diminished value of the Goods resulting from their use in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.
  10. The right of withdrawal from the contract does not apply in cases provided by law, in particular concerning non-prefabricated Goods, manufactured according to the Customer's specifications or serving to satisfy their individualized needs.

XI. Exchanges

  1. We do not offer exchanges. If you want a different product - return the order and place a new one.

XII. Complaints regarding Goods

Customers who are Consumers and Privileged Entrepreneurs

  1. The Seller undertakes to deliver Goods in conformity with the contract.
  2. In case of non-conformity of the Goods with the contract, the Customer may exercise the rights provided for by legal provisions.
  3. Complaints can be submitted:
    • by e-mail: info@yasashiokami.com
    • in writing: Słowicza 10, 53-320 Wrocław
  4. It is recommended to provide in the complaint:
    • the name and surname or company name of the Customer,
    • contact details,
    • order number,
    • description of the non-conformity,
    • the desired method of complaint resolution, if the Customer wishes to specify it.
  5. If delivery of the Goods is necessary for the complaint to be processed, the Seller will inform the Customer about the method of transfer.
  6. The Seller will process the complaint within 14 days from the date of its receipt.

Customers who are Entrepreneurs

  1. In relations with the Seller concerning Entrepreneurs, excluding Privileged Entrepreneurs, the Seller's liability under warranty is excluded to the broadest extent permissible by law.

XIII. Warranty

  1. Some Goods may be covered by a warranty.
  2. Information about the existence of the warranty, its content, and duration is always indicated in the description of a given Good in the Store.

XIV. Out-of-court dispute resolution

  1. A Consumer may use out-of-court methods of complaint resolution and claim assertion, in particular:
    • contact the competent provincial inspector of the Trade Inspection,
    • seek assistance from a municipal or district consumer ombudsman,
    • seek assistance from social organizations dealing with consumer protection.
  2. Detailed information about the possibilities of amicable dispute resolution can be obtained, among others, on the websites of UOKiK and the Trade Inspection.

XV. Personal data protection

  1. Customers' personal data are processed in accordance with applicable legal provisions and the Privacy Policy available in the Store.
  2. Detailed rules for the processing of personal data, the use of cookies, and analytical and marketing tools are defined in the Privacy Policy.

XVI. Final Provisions

  1. All rights to the Store, its name, domain, content, photos, descriptions, graphic symbols, and materials posted by the Seller belong to the Seller or authorized entities and are subject to legal protection.
  2. In matters not regulated in these Terms and Conditions, the relevant provisions of Polish law apply.
  3. Provisions concerning the Consumer also apply to the Privileged Entrepreneur, if legal provisions so state.
  4. Any disputes with a Consumer will be resolved by the court competent according to universally applicable provisions.
  5. Any disputes with an Entrepreneur will be resolved by the court competent for the Seller's registered office.
  6. The Seller may amend the Terms and Conditions for important reasons, in particular due to:
    • changes in legal provisions,
    • changes in payment or delivery methods,
    • changes in the functionality of the Store,
    • the need to clarify the provisions of the Terms and Conditions.
  7. Changes to the Terms and Conditions do not affect the acquired rights of Customers who concluded contracts before the changes came into force.
